Authorized Use of Our Photos
We don't mind fair use, giving us proper credit, but we take THEFT and misuse of our images seriously. We do give permission in most reasonable use cases, under the following conditions:
1. The site or blog is not using our copyrighted photos to sell their own competing products.
2. Our name (originally on our photo) has NOT been obscured, blurred, cropped off or covered up.
3. The site or blog gives us proper credit, clearly stating that the photo came from us at www.etherealdecor.com, somewhere close to the picture, giving our web address with a back link to our website or just our web address without an actual backlink. Both is better.
4. The site does not link to any type of pornographic or typically objectionable material.
If we use an image from somewhere else, such as the Famous Crystal Tree seen in Bride's magazine using fine Swarovski crystals and now seen on numerous other websites, we state what magazine or business it came from and give the website as well. Reciprocal benefit to the magazine. If we use an actual Product Photo from another website, there is a reciprocal benefit as we mention that business for our customers to visit for items we don't sell. In some cases, we use photos for which we have paid a hefty sum to the actual photographer for rights to use the photograph.
What We Do Regarding Theft or Unauthorized Use of Our Photos
Beyond thes basic guidelines listed above, we do reserve the right to take each situation on a case by case bases. In some cases, we contact the webmaster and demand the photo removed if it is being used unfairly and dishonestly. In other cases, we will contact the host of the website. Finally, we would forward the information to our lawyer to contact the site owner and consider a law suit for copyright infringement and monetary damages.
Is all This Really Necessary?
Yes. Crystals are tough to photograph and cheap crystals are that much harder to photograph so people tend to steal. We search it out using Google regularly and Google Images search. We search actively for the actual photos and also cropped sections of our photos or portions of our photos cloned or copied onto other photos or backgrounds. We search for our content (written words) using Copyscape which monitors the internet for plagiarism of our copy and our e-book. We also get email tips from visitors to our site, who point us to other websites. When we find it, we deal with it.
If the intent is to post our picture and give information, it's usually ok. If the intent is to post our pictures to sell on another site (even if they purchased the items in the picture from us), it is not authorized or tolerated. If the products were purchased from us, the person or company has to take their own photographs of the item, not obscure our name on our photos.
